Who is responsible
Partition of joint holdings is a revenue proceeding in Bihar, initiated by the co-sharers holding the share, and concluded by an allotment of shares. Where the parties cannot agree, the matter is decided by the revenue court on the basis of possession and contribution.
Important condition: Bihar tenancy law governs the rights of sharecroppers and tenants in a partition; whether a cultivator or tenant can claim a share is a legal question that depends on the record and the status of the person.
